Advanced English Tense Review (ESL, EFL, TESL, TOEFL)

Advanced English Tense Review (ESL, EFL, TESL, TOEFL) Its back-to-school time. Before you or your students get down to studying the specifics of various grammar structures, it is a good idea to review the basic English tenses. If you are an advanced student, a review will help remind you of the tenses and also point out any weaknesses or insecurity that you may have. If you are an upper-level student but not yet aware of all the tenses, these exercises will make a good introduction to some of the important structures ahead. For an overview of conjugation in detail of all 12 tenses in English, use the tense tables for reference. Teachers can use theses guides on how to teach tenses for further activities and lesson plans in class The following exercises serve two purposes: Re-familiarization of standard tense names Tense conjugation practice The first exercise is very important as you may not remember exactly the names of the various tenses. This exercise will help you remember the names of the tenses. Once you have finished the first exercise, read the text through one more time to familiarize yourself with it completely. Go on to the next exercise that asks you to conjugate the verbs in the extract. You should be very familiar with the extract so you can concentrate on the correct conjugation. Notice how the tenses relate to each other in time. Remember that many verbs are conjugated based on how they relate to one another. Teachers can use these exercises in class by using the following lesson plan which includes the exercises in a format useful for the classroom. Tense Review Lesson Plan and Materials Here is the original text. Once you have finished, click on the exercise link to begin exercise one. John has always traveled a lot. In fact, he was only two years old when he first flew to the US. His mother is Italian and his father is American. John was born in France, but his parents had met in Cologne, Germany after they had been living there for five years. They met one day while Johns father was reading a book in the library and his mother sat down beside him. Anyway, John travels a lot because his parents also travel a lot. As a matter of fact, John is visiting his parents in France at the moment. He lives in New York now, but has been visiting his parents for the past few weeks. He really enjoys living in New York, but he also loves coming to visit his parents at least once a year. This year he has flown over 50,000 miles for his job. He has been working for Jackson Co. for almost two years now. Hes pretty sure that hell be working for them next year as well. His job requires a lot of travel. In fact, by the end of this year, hell have traveled over 120,000 miles! His next journey will be to Australia. He really doesnt like going to Australia because it is so far. This time he is going to fly from Paris after a meeting with the companys French partner. Hell have been sitting for over 18 hours by the time he arrives! John was talking with his parents earlier this evening when his girlfriend from New York telephoned to let him know that Jackson Co. had decided to merge with a company in Australia. The two companies had been negotiating for the past month, so it really wasnt much of a surprise. Of course, this means that John will have to catch the next plane back to New York. Hell be meeting with his boss at this time tomorrow. Follow the links to begin the exercise: Exercise One: Tense Identification Exercise Two: Tense Conjugation

Last Glacial Maximum - Last Major Global Climate Change

Last Glacial Maximum - Last Major Global Climate Change The Last Glacial Maximum (LGM) refers to the most recent period in earths history when the glaciers were at their thickest and the sea levels at their lowest, roughly between 24,000–18,000 calendar years ago (cal bp). During the LGM, continent-wide ice sheets covered high-latitude Europe and North America, and sea levels were between 400–450 feet (120–135 meters) lower than they are today. At the height of the Last Glacial Maximum, all of Antarctica, large parts of Europe, North America, and South America, and small parts of Asia were covered in a steeply domed and thick layer of ice. Last Glacial Maximum: Key Takeaways The Last Glacial Maximum is the most recent time in earths history when the glaciers were at their thickest.  That was approximately 24,000-18,000 years ago.  All of Antarctica, large parts of Europe, North and South America, and Asia were covered by ice.  A stable pattern of glacial ice, sea level, and carbon in the atmosphere has been in place from about 6,700 years. That pattern has been destabilized by global warming as a result of the Industrial Revolution.   Evidence The overwhelming evidence of this long-gone process is seen in sediments laid down by sea level changes all over the world, in coral reefs and estuaries and oceans; and in the vast North American plains, landscapes scraped flat by thousands of years of glacial movement. In the lead up to the LGM between 29,000 and 21,000 cal bp, our planet saw constant or slowly increasing ice volumes, with the sea level reaching its lowest level (about 450 feet below todays norm) when there was about 52x10(6) cubic kilometers more glacial ice than there is today. Characteristics of the LGM Researchers are interested in the Last Glacial Maximum because of when it happened: it was the most recent globally impacting climate change, and it happened and to some degree affected the speed and trajectory of the colonization of the American continents. The characteristics of the LGM that scholars use to help identify the impacts of such a major change include fluctuations in effective sea level, and the decrease and subsequent rise in carbon as parts per million in our atmosphere during that period. Both of those characteristics are similar- but opposite to- the climate change challenges we are facing today: during the LGM, both the sea level and percentage of carbon in our atmosphere were substantially lower than what we see today. We do not as yet know the entire impact of what that means to our planet, but the effects are currently undeniable. The table below shows the changes in effective sea level in the past 35,000 years (Lambeck and colleagues) and parts per million of atmospheric carbon (Cotton and colleagues). Years BP, Sea Level Difference, PPM Atmospheric Carbon2018, 25 centimeters, 408 ppm1950, 0, 300 ppm1,000 BP, -.21 meters -.07, 280 ppm5,000 BP, -2.38 m /-.07, 270 ppm10,000 BP, -40.81 m /-1.51, 255 ppm15,000 BP, -97.82 m /-3.24, 210 ppm20,000 BP, -135.35 m /-2.02, 190 ppm25,000 BP, -131.12 m /-1.330,000 BP, -105.48 m /-3.635,000 BP, -73.41 m /-5.55 The major cause of sea level drop during the ice ages was the movement of water out of the oceans into ice and the planets dynamic response to the enormous weight of all that ice atop our continents. In North America during the LGM, all of Canada, the southern coast of Alaska, and the top 1/4 of the United States were covered with ice extending as far south as the states of Iowa and West Virginia. Glacial ice also covered the western coast of South America, and in the Andes extending into Chile and most of Patagonia. In Europe, the ice extended as far south as Germany and Poland; in Asia ice sheets reached Tibet. Although they saw no ice, Australia, New Zealand and Tasmania were a single landmass; and mountains throughout the world held glaciers. The Progress of Global Climate Change Visitors walking on a trail that leads to the melting and rock-covered Pasterze glacier hike past a lake of glacier water in a rocky basin once filled at least 60 meters deep by glacier ice on August 27, 2016 near Heiligenblut am Grossglockner, Austria. The European Environmental Agency predicts the volume of European glaciers will decline by between 22% and 89% by 2100, depending on the future intensity of greenhouse gases.   Sean Gallup/Getty Images The late Pleistocene period experienced a sawtooth-like cycling between cool glacial and warm interglacial periods  when global temperatures and atmospheric CO2 fluctuated up to 80–100 ppm corresponding with temperature variations of 3–4 degrees Celsius (5.4–7.2 degrees Fahrenheit): increases in atmospheric CO2 preceded decreases in global ice mass. The ocean stores carbon (called carbon sequestration) when the ice is low, and so the net influx of carbon in our atmosphere which is typically caused by cooling gets stored in our oceans. However, a lower sea level also increases salinity, and that and other physical changes to the large-scale ocean currents and sea ice fields also contribute to carbon sequestration. The following is the latest understanding of the process of climate change progress during the LGM from Lambeck et al. 35,000–31,000 cal BP- slow fall in sea level (transitioning out of Ã…lesund Interstadial)31,000–30,000 cal BP- rapid fall of 25 meters, with rapid ice growth especially in Scandinavia29,000–21,000  cal BP- constant or slowly growing ice volumes, eastward and southward expansion of the Scandinavian ice sheet and the southward expansion of the Laurentide ice sheet, lowest at 2121,000–20,000 cal BP- onset of deglaciation,20,000–18,000 cal BP- short-lived sea level rise of 10-15 meters18,000–16,500 cal BP- near constant sea level16,500–14,000 cal BP- major phase of deglaciation, effective sea level change about 120 meters at an average of 12 meters per 1000 years14,500–14,000 cal BP- (Bà ¸lling- Allerà ¸d warm period), high rate of se-level  rise, average rise in sea level 40 mm annually14,000–12,500 cal BP- sea level rises ~20 meters in 1500 years12,500–11,500 cal BP- (Younger Dryas), a much-reduced rate of s ea-level  rise11,400–8,200 cal BP- near-uniform global rise, about 15 m/1000 years8,200–6,700 cal BP- reduced rate of sea-level  rise, consistent with the final phase of North American deglaciation at 7ka 6,700 cal BP–1950- progressive decrease in sea level rise1950–present- first sea rise increase in 8,000 years Global Warming and Modern Sea Level Rise By the late 1890s, the industrial revolution had begun throwing enough carbon into the atmosphere to impact the global climate and start the changes that are currently underway. By the 1950s, scientists such as Hans Suess and Charles David Keeling began to recognize the inherent dangers of human-added carbon in the atmosphere. The global mean sea level (GMSL), according to the Environmental Protection Agency, has risen nearly 10 inches since 1880, and by all measures appears to be accelerating.   Most early measures of current sea level rise have been based on changes in tides at the local level. More recent data comes from satellite altimetry that samples the open oceans, allowing for precise quantitative statements. That measurement began in 1993, and the 25-year record indicates that the global mean sea level has risen at a rate of between 3/-.4 millimeters per year, or a total of nearly 3 inches (or 7.5 cm) since records began. More and more studies indicate that unless carbon emissions are decreased, an additional 2–5 feet (.65–1.30 m) rise by 2100 is likely.   Specific Studies and Long-Term Predictions U.S. Fish and Wildlife ecologist Phillip Hughes inspects dead buttonwood trees which have succumbed to salt water incursion in Big Pine Key, Florida. Since 1963, the Florida Keys upland vegetation is being replaced by salt tolerant vegetation.   Joe Raedle/Getty Images Areas already impacted by sea level rises include the American east coast, where between 2011 and 2015, sea levels rose up to five inches (13 cm). Myrtle Beach in South Carolina experienced high tides in November 2018 which flooded their streets. In the Florida Everglades (Dessu and colleagues 2018), sea level rise has been measured at 5 in (13 cm) between 2001 and 2015. An additional impact is an increase in salt spikes changing the vegetation, due to an increase in inflow during the dry season. Qu and colleagues (2019) studied 25 tidal stations in China, Japan and Vietnam and tidal data indicate that the 1993–2016 sea level rise was 3.2 mm per year (or 3 inches).   Long-term data have been collected throughout the world, and estimates are that by 2100, a 3–6 feet (1–2 meter) rise in the Mean Global Sea Level is possible, accompanied by a 1.5–2 degree Celsius in overall warming. Some of the direst suggest a 4.5-degree rise is not impossible if carbon emissions are not reduced.  Ã‚   The Timing of the American Colonization According to the most current theories, the LGM impacted the progress of human colonization of the American continents. During the LGM, entry into the Americas was blocked by ice sheets: many scholars now believe that the colonists began entering into the Americas across what was Beringia, perhaps as early as 30,000 years ago. According to genetic studies, humans were stranded on the Bering Land Bridge during the LGM between 18,000–24,000 cal BP, trapped by the ice on the island before they were set free by the retreating ice. Monetary policy Research Paper Example | Topics and Well Written Essays - 1750 words

Monetary policy - Research Paper Example It lays a vital role in opening up the financial market of a country. It also has supervisory powers, aimed at limiting banks and financial intermediaries from reckless behaviour. In developed nations Central banks are independent so that they operate under rules made to help them operate in a political free management (Kurgan and Wells 387). Therefore, this paper aims at obtaining a deep analysis on the role of central bank in use and implementation of monetary policy to stabilize the economy. This will be with respect to the great depression of 1929 to early 1940s. Monetary policy is the mean through which the monetary tools of a country control the flow of money. It mostly focuses on the rate of interest with an aim of promoting economic growth and stability. It is key role is to sustain, stable prices and maintain low levels of unemployment. Monetary policy can either be expansionary of contractionary. Expansionary policies increase the supply of money in the economy while the co ntractionary measurers reduce the total money supply to the economy (Bofinger, Reischle and Schachter 123). Expansionary policy is theoretically used to control unemployment in a recession by lowering interest rates in the view that easy credit will motivate businesses into expanding. Contractionary policy is intended to slow inflation in a view of curbing the resulting deterioration and distortions of asset values. The Monetary policies advocated by the central bank helps in fostering the growth of financial market by encouraging open market operations. It is the most used tool by the central bank of each country to correct any economic disorder or to set the pace of a country economic growth (Bofinger, Reischle and Schachter 170). Economic depression is an economic slowdown where the gross domestic product is expected to decline at around 10%. To give rise to greet economic depression, the gross domestic product was believed to have declined by at least 33% per annum. This is the worst in history so far. Economic depression is characterized by; reduced consumption by individuals and the government, increased liquidation of the banking system or narrowing of financial market to the extent that it cannot allocate capital inflow to various sectors of the economy, high levels of unemployment expressed in two digits, insolvency of economic driving companies, a reduction in the wage rate for example, during the great economic depression it reduced sixty percent and acute shortage of money supply in the economy. Thus, depression can be defined as a recession that lasts longer and has a massive decline in business activity thus a slowdown in economic growth (Bofinger, Reischle and Schachter 213). Central bank and monetary policy with respect to the great depression of 1929 to early 1940s can be analyzed from different views. The great depression lasted for 10 years. This occurred when the shares traded in a day tripled followed by a drastic fall in price by about 24 %. The great economic depression was characterized by an increased rate in unemployment which increased by 22% of the total country workforce. The total gross domestic product reduced by half as the price fell by 10%. The depression also caused farmers to lose their farms, and this made them together with the unemployed to move to urban areas in search of daily earnings, this lead to development of shanties thus creation more problems. There were massive bank failures and

Stem Cells Essay Example | Topics and Well Written Essays - 750 words

Stem Cells - Essay Example Stem cells are not specialized and have the capacity of renewing themselves through a biological process called cell division. Moreover, research has shown that when stem cells can be induced to become specific organ specific cells or became a tissue with special functions (US Department of Health and Human Services, 2002). Stem cells play a critical role in some organs like the bone marrow and the gut whereby they divide regularity to replace damaged or worn out tissues. There are two major kinds of stem cells. They include embryonic stem cells and somatic or adult stem cells. Stem cells are important for any living organisms in many ways (US Department of Health and Human Services, 2002). In this scenario, 3-5 years old blastcyst or the embryo inner cells give rise to all body tissues and organs with different specialized functions like the heart, lungs, eggs, sperm cells and many other cells with different specialized functions. Moreover, on adults, stem cells play a crucial role through the regeneration capacity they are able to regenerate cells that have been lost through disease, normal wear or injury. Due to their unique capacity to regenerate new cells, stem cells have played a potential role in treating diseases like heart diseases and diabetes. Research is ongoing to establish on how to use these cells to treat disease, and there are several achievements in this field that is now called reparative or regenerative medicine. One of the cons surrounding the stem cells is controversy concerning the ethics. This is because until recent years scientists have been using aborted embryo to derive the embryonic stem cells from which is unethical. However, with the advancement of technology, researchers currently use ethical methods like the Induced Pluripotent Stem cells (iPS). The cells are artificially derived from non-pluripotent cell like the somatic cells (Explorable.com, 2008). The use of pluripotent stem cells had shunned the controversial

Basic Wound Care Essay Example | Topics and Well Written Essays - 500 words

Basic Wound Care - Essay Example It results when additional pressure interrupts blood flow through the skin. This results in oxygen and nutrient deficiency in the affected skin, which makes it break leading to the formation of the ulcer. Pressure from a hard surface, for instance, wheelchair and bed can cause an ulcer (Dziedzic, 2013). Involuntary muscle movements is another cause besides moisture, which can break down the epidermis. We will focus on old age and terminal disease as some of the risk factors. Individuals, who are old have their skin aging out, which results in loss of elasticity. There is a decline in the blood flow through the skin, which is due to aging effects. Additionally, the amount of fat under the skin decreases as one gets older. All these put together makes the skin vulnerable to damage; hence, an ulcer formation. We will now look at some terminal diseases in patients that can put them at increased risk of pressure ulcers (Qaseem, Humphrey, Forciea, Starkey, & Denberg, 2015). Type one and two diabetes results in increased blood sugar levels, which disrupts the normal flow of blood. In peripheral arterial disease, build-up of fatty substance in arteries hampers blood supply to legs. Heart failure results in reduced blood supply to other parts of the body. Kidney failure results in build-up of harmful toxins, which can cause damage to tissues. Reducing the risk of infection demands regular hand washing, debridement and wound cleansing. Protect the wound from exogenous sources of contamination such as feces (Kifer, 2012). When dressing the wound, clean it using sterile water, topical antiseptic or saline, which reduces the bacterial growth and risk of infection. In cases of foul odor, debridement, and frequent cleansing is necessary. Measurement monitors progress made in the healing process through changes in width, length, volume and area of the wound. Simple measurement technique involves measuring the

Modern Allusions Of Shakespeares Romeo And Juliet Film Studies Essay

Modern Allusions Of Shakespeares Romeo And Juliet Film Studies Essay Shakespeares play Romeo and Juliet models a traditional love story for todays entertainment. Romeo and Juliet chronicles the feuding between the Montague and Capulet families. The intense rivalry between these two families forbade any interactions between their members. Romeo and Juliet were both in attendance at a party and as their eyes met across the ballroom, Romeo and Juliet experienced love at first sight. Their love was deep and forbidden, yet the young lovers secretly married. The continued feuding between their families drove Romeo and Juliet to their untimely deaths. Modern music, TV shows, and movies frequently use allusions from Shakespeares Romeo and Juliet. Whether the story of the young lovers is portrayed on television, film, Broadway, or in music lyrics, people have always enjoyed the story of Romeo and Juliet. Themes including forbidden love, destiny and time, and the forcefulness of love are influential in the creation of new, up-to-date productions. Perhaps the one theme that no one can forget is the forbidden love of star-crossed lovers. Most creations in todays entertainment depict the illicit love between two young people from rival groups. During the Renaissance period, attending afternoon plays was a popular pastime. Now that technology plays such a major role in entertainment, our new favorite activity is watching television in the comfort of our own homes. Numerous television shows have made references in their programs to Romeo and Juliet. Popular shows targeted at todays youth including: Hey Arnold!, Family Matters, Neds Declassified School Survival Guide, Hannah Montana, and The Brady Bunch, have all showcased Romeo and Juliet as a school play. Typically the television shows main character earns the role of either Romeo or Juliet, depending on his or her gender. The opposing love interest role is played by a passionate character that appears to have a crush on the main character. By creating these episodes, the writers and producers help remind viewers of the tragic love story of Romeo and Juliet. Music plays a prominent role in many cultures throughout the world. The lyrics of much of todays popular music, focuses on love, relationships, and lifes struggles. Shakespeares Romeo and Juliet also demonstrates these same topics. The tragic love story of Romeo and Juliet is recounted in the lyrics of artists including, Taylor Swift and the Dire Straits. In the song Love Story, Taylor Swift recites the story of Romeo and Juliet throughout her lyrics. She sings, We were both young when I first saw you/ I close my eyes, And the flashback starts/Im standing there / On a balcony in summer air/ See the lights, See the party, the ball gowns /I see you make your way through the crowd/ And say hello/ little did I knowà ¢Ã¢â€š ¬Ã‚ ¦. Taylor Swift grasped the tragic story of love lost and fashioned it into her own song. Romeo and Juliet by the Dire Straits translates Shakespeares story into modern slang. The band sings, Juliet says, Hey, its Romeo, you nearly gave me a heart attack!, Hes underneath the window, shes singing, Hey la, my boyfriends back. You shouldnt come around here singing up to people like thatAnyway, what you gonna do about it?' Through their music, the Dire Straits recreate the balcony scene where Romeo and Juliet profess their love for one another. Several music artists have covered this song including, The Killers, The Indigo Girls, and Lisa Mitchell. Today, many artists refer to Romeo and Juliet for lyrical inspiration. The love story of Romeo and Juliet is frequently portrayed on the big screen and the stage. Cinematic productions such as The Ringer, West Side Story, Gnomeo and Juliet, The Baz Romeo and Juliet, and the Zeffereli version of Romeo and Juliet, utilize allusions from Shakespeares Romeo and Juliet. The Ringer is a movie about an average, working-class man who in an effort to repay a large debt to his friend, tampers with the Special Olympics and pretends that he is a special needs athlete. The movie showcases special needs athletes working together in their free time to produce their version of Romeo and Juliet for the stage. The play helps to solidify the relationship between the main character and his love interest. Gnomeo and Juliet is a computer animated movie that takes kids on a wild journey through the story of Romeo and Juliet. Gnomeo and Juliet is about two rivaling gnome families: the Montagues and the Capulets. The movie takes the general concepts of Romeo and Juliet and transforms it into a kid-friendly adventure that retells the basic story of Romeo and Juliet. West Side Story is about two gangs: the Puerto Rican Sharks and the rich, white Jets. The movie is set in New York City in the 1950s. The Sharks and the Jets are from different backgrounds which has caused a rivalry to form between the two groups. A love affair between members of each gang comes between the rivalry, as it did in Shakespeares Romeo and Juliet. The forbidden love results in feuding between the gangs. West Side Story has also been adapted for the main stage and remains in production both on and off Broadway. Shakespeares Romeo and Juliet continues to serve as a traditional love story which inspires artists to create and fashion their own unique interpretations through various forms of entertainment. Modern music, TV shows, and movies make frequent allusions to Shakespeares Romeo and Juliet as they showcase the themes of forbidden love, destiny and time, and the forcefulness of love.

Family and Gender Relations :: essays research papers

Assignment One – Short Essay ] Topic: Family and gender relations Drawing on the concepts of globalisation and globalism discussed in your textbooks and the Reader, address the following question: Does globalisation represent a radically new period in human history? Jan Scholte (2000:39) wrote about globalisation, that the only consensus is that it is contested. â€Å"People have held widely differing views regarding definition, scale, chronology, impact and policy (Scholte 2000:39). Use of the term globalisation is high and yet a common understanding of its meaning and where it fits in the history of mankind is frequently vague and based on assumption rather than evidence (Scholte 2000:1). Using one definition from many, of globalisation and globalism and the changes through history that sociologists have used to make sense of the phenomenon, this essay will demonstrate that while globalisation represents both a new and old period in human history, it can only be called radical in its recent state. The working definition of globalisation used in this essay, has been separated from Jan Scholte’s five broad definitions (2000:15). Deterritorialisation or supraterritorioality is based on the process of change to geography in which territorial boundaries become less important (Scholte 2000:16). This concept encompasses all other definitions that Scholte identified, as it has a wide focus which allows each to be occurring because of this change in geography. Robin Cohen and Paul Kennedy’s definitions of globalisation (Cohen and Kennedy 2000:11) are not in opposition with the concept of supraterritoriality, describing it ‘as the ways in which the world is being knitted together’ and ‘the objective, external ties that bind us together’. To fully understand globalisation it is necessary to differentiate it from globalism. It is described as the ‘subjective realm’, unlike globalisation which refers to a series of ‘objective changes in the world that are partly outside us’ (Cohan and Kennedy 2000:34). To simplify, this describes the collective way in which the world views itself as a result of globalisation. Globalism is seen as a result of globalisation and as such quite a new phenomenon (Cohan and Kennedy 2000:34). It is quite important to make this differentiation as many times when writers are referring to globalisation as new phenomenon they are using examples that are in fact forms of globalism, a distinctly different concept. Is globalisation a new or old? Opinions on this tend to cross over while identifying different phases. Cohen and Kennedy believe that globalisation can be traced back through history, but that its processes have accelerated in recent years (Cohan and Kennedy 2000:34).

Why RBOCs Believe They Need Regulatory Relief to Offer High essays

Why RBOCs Believe They Need Regulatory Relief to Offer High essays The RBOCs have been screaming for relief of what they believed to be harsh restrictions performed by the FCC ever since the AT The Tauzin-Dingell Bill essentially tries to put an end to such restrictions particularly on inter-LATA data offerings. The Bill, which was backed up by the baby Bells, argues that section 706 of the TA96 calls for deployment of advanced telecom services and the current FCC rules are definitely slowing it down. FCC prescribed requirements on unbundling network elements include line sharing and collocation of CLECs equipments in the ILECs central offices, which the ILEC say is deterring them from deploying high-speed Internet access nationwide. [ISP News, 2001] The RBOCs claim that they are pushing for the bill because TA96 failed to predict that cable companies would monopolize the high-speed internet market and that the RBOCs are no match for these companies now with their (ILECs) existing copper wire. As in June 2001, cable modem service had 5.2 million subscribers, compare with 2.7 million DSL subscribers to the ILECs [Dallas News1, 2002]. Furthermore, with FCC regulated wholesale rates on services they are selling to CLECs, the RBOCs cannot justify the investment needed to upgrade their phone lines to accommodate for high-speed broadband services and someday, even faster data services. The Tauzin-Dingell bill allows the Bells to charge competitor market price for access to their lines with little FCC supervision. [Dallas...

Transmission Lines Easements and Personal Property Research Paper

Transmission Lines Easements and Personal Property - Research Paper Example As early as in 1625, Hugo Grotius has defined eminent domain as â€Å"The property under question is under the eminent domain of the government or state so that the government or anybody who functions for such a state may employ or even destroy or alienate such property, not only in the event of an extreme situation but also for the needs of public purpose or utility, to which ends those who have made civil society must have presumed to have meant that private purpose or ends should give away. However, it is to be noted that the government or state must be liable to make good the loss to the owner’s of the property which has been taken by the government.† Both federal and state governments have the privilege to take away the private property for public use with payment of just compensation to affected landowners. The Fifth Amendment to the American Constitution sets the tone for these seizures, and this power is widely known as eminent domain. In the historical decision in Kelo v. City of New London , U.S Supreme Court held that seizing the private property of land owners for economic development was entitled as a public use within the context of the Fifth Amendment. The above decision by U.S government has enlarged the both the federal and state government’s authority of eminent domain to unmatched areas. In Berman v Parker, in 1954, the U.S Supreme Court decided unanimously that the Fifth Amendment authorized governments to seize the private properties not for public use but for the public purpose. (scholarsandrogues.wordpress.com). U.S Supreme Court held in Kelo v. City of New London1, that the employment of eminent domain to convey rights of a land from one private owner to another one for the furtherance of the economic development. The appeal to U.S Supreme Court happened from the fact of censure by New London, Connecticut of privately owned real estate so that it could be employed as part of a widespread redevelopment scheme. In a 5- 4 decision, U.S Supreme Court held that general advantages a community savored from economic development qualified such redevelopment schemes as an allowable â€Å" public usage† under the Takings Clause of the Fifth Amendment. The Supreme Court verdict in Kelo was widely condemned by American general public and the politicians. American public is of the view that decision in Kelo is a gross infringement of property rights. They also allege that the Taking Clause of the Fifth Amendment was against general public’s interest as it would be beneficial to giant business houses at the loss of local communities and individual land owners. Further, some critics allege that Kelo decision has removed the constitution protection offered by Federal government to individual property rights and placed the issue back to the state governments to fix on if any protection remains on any state-level. In the above case , the Supreme Court deliberated whether the â€Å" public use  " requirement of the Fifth Amendment is satisfied in city’s decision to attach the private properties exclusively for the purpose of economic development. The City of New London, Connecticut wished to enlarge for the stated objectives of â€Å"revitalizing a distressed city by economically including its waterfront and downtown areas by taking over Kelo, which involved 90 acres of land owned by private owners. As per City, the development would foster in excess of 1000 jobs and an increase in taxes and other income. From the willing sellers, the City
